Terms of Service

1. About These Terms

These Terms of Service govern your access to and use of UmByul (음별), a music rating and review service operated by MinBapE.

They set out the rights, responsibilities, conditions, and procedures that apply between you and us when you use the Service.

2. Definitions

For the purposes of these Terms:

  1. “Service” means UmByul and all related services we provide that allow users to rate, review, share, and discover music and related content.
  2. “you” means a person who agrees to these Terms, creates an account, and uses the Service.
  3. “User Content” means any content you submit, post, or make available through the Service, including ratings, reviews, comments, Mixes, and profile information.
  4. “Mix” means a collection or list of music created by a user.
  5. “Experience Points,” “XP,” and “Levels” mean non-monetary indicators of activity, progress, or trust calculated within the Service.
  6. Any terms not defined in these Terms will be interpreted in accordance with applicable laws and generally accepted practices.

3. Changes to These Terms

We will make these Terms available within the Service.

We may update these Terms when necessary, provided that the changes do not violate applicable laws. When we make changes, we will notify you of the effective date and the reason for the changes at least seven days in advance.

If a change is materially disadvantageous to you or otherwise significant, we will provide notice at least 30 days before the change takes effect.

We may record and retain the version of the Terms that you agreed to. We may also ask you to agree again when we make an important change.

By continuing to use the Service after updated Terms take effect, you will be considered to have accepted them. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

4. Creating and Using Your Account

You may create an account by agreeing to these Terms and registering through either:

  1. an email address and password, including verification through an email authentication code; or
  2. a supported third-party authentication provider, such as Google or Discord.

You must be at least 14 years old to create an account. We may ask for your date of birth during registration and restrict access if you are under the age of 14.

You must provide accurate information and must not use another person’s information or submit false information.

You are responsible for keeping your account and authentication information secure. You must not allow another person to use your account.

If you become aware of unauthorized access to or use of your account, you must notify us promptly.

5. The Service We Provide

The Service may include features such as:

  1. rating and reviewing music;
  2. viewing reviews and comments;
  3. creating and sharing Mixes;
  4. discovering music based on preferences;
  5. viewing charts;
  6. following other users;
  7. receiving notifications; and
  8. viewing daily music selections curated by us.

We may modify, add, suspend, or discontinue all or part of the Service when reasonably necessary for technical, operational, security, or improvement purposes.

The Service is provided free of charge. Other than voluntary donations described in Section 10, we do not charge you for using the Service.

The Service does not currently include paid features or in-app purchases.

6. Service Availability

We may temporarily suspend or restrict the Service due to circumstances such as:

  1. system inspections, maintenance, repairs, or replacement;
  2. communication or network failures;
  3. natural disasters or other events beyond our reasonable control; or
  4. failures involving third-party providers, including hosting, authentication, or music data providers.

Because the Service is provided free of charge, we are not responsible for losses resulting from its suspension, modification, or unavailability, except where liability cannot be excluded under applicable law.

7. Your Content

You retain ownership of the copyright and other rights in the User Content you create.

By submitting User Content to the Service, you grant us a worldwide, royalty-free, non-exclusive license to use that content as reasonably necessary to operate, display, promote, and improve the Service.

This license may include the right to:

  1. reproduce;
  2. transmit;
  3. publish;
  4. display;
  5. edit or modify the content to the extent necessary; and
  6. create derivative works for purposes related to the Service.

This license does not transfer ownership of your User Content to us.

If you delete your User Content or close your account, the license may continue only to the extent necessary for:

  1. uses that were already made before deletion;
  2. backup and recovery systems;
  3. legal or regulatory retention requirements; and
  4. the continued operation of features involving content shared with other users.

We may use your ratings, reviews, and other User Content to analyze your preferences and provide personalized recommendations.

You are responsible for any external links included in your User Content, including links to music included in a Mix.

8. Managing User Content

You may edit or delete your own User Content through the features provided by the Service.

We may remove, hide, restrict, or disable access to User Content if we reasonably believe that it:

  1. violates these Terms;
  2. violates applicable law;
  3. infringes another person’s rights; or
  4. threatens the security or normal operation of the Service.

Where urgent action is necessary, we may take these measures without prior notice.

User Content that we remove or restrict may be retained internally for a reasonable period when necessary for dispute resolution, abuse prevention, legal compliance, or operation of the Service.

9. Experience Points and Levels

XP and Levels are non-monetary indicators calculated based on activities such as writing reviews or receiving likes.

XP and Levels:

  1. have no cash value;
  2. cannot be exchanged for money, goods, or services;
  3. cannot be transferred or refunded; and
  4. do not represent ownership or any other property right.

We may change how XP and Levels are calculated or displayed as the Service develops.

10. Voluntary Donations

You may voluntarily support us through an external donation platform, such as Ko-fi.

A donation is a voluntary contribution and does not entitle you to any product, service, benefit, reward, or other consideration.

Payment processing, cancellations, and refunds are handled according to the terms and policies of the applicable external platform.

11. Acceptable Use

You must not use the Service to:

  1. infringe another person’s rights, including copyright, portrait rights, privacy rights, or reputation;
  2. post abusive, defamatory, discriminatory, hateful, obscene, or otherwise seriously offensive content;
  3. post content that violates public order, accepted standards of conduct, or applicable law;
  4. submit false information;
  5. manipulate ratings, reviews, likes, XP, Levels, charts, or other indicators;
  6. use bots, crawlers, scripts, or other automated tools to access the Service improperly or create excessive load;
  7. interfere with the normal operation or security of the Service;
  8. gain or attempt to gain unauthorized access to systems, accounts, or data; or
  9. engage in any other conduct that violates these Terms or applicable law.

12. Enforcement and Account Restrictions

If you violate these Terms, we may take one or more of the following actions:

  1. issue a warning;
  2. remove or restrict User Content;
  3. restrict access to certain features;
  4. temporarily suspend your account; or
  5. permanently suspend or terminate your access to the Service.

You may report or block another user through the features provided by the Service. We may review reports and take appropriate action based on the circumstances.

We will generally notify you of the reason for and duration of an enforcement action.

However, we may act before providing notice where a violation is clear, urgent, or likely to cause harm to users, third parties, or the Service.

13. Third-Party Services and Music Data

The Service may display music-related information obtained from third parties such as Spotify. This information may include:

  1. album, track, and artist metadata;
  2. cover images; and
  3. explicit-content information.

Unless expressly stated otherwise, we are not affiliated with, sponsored by, endorsed by, or officially associated with Spotify or any other third-party platform.

The Service does not directly play, host, or stream music. Where available, we may provide links that allow you to listen through external services such as Spotify or YouTube.

We may use third-party providers, including Supabase and Cloudflare, for purposes such as:

  1. authentication;
  2. database and file storage;
  3. image storage;
  4. email delivery;
  5. hosting and security; and
  6. bot and abuse prevention.

Information about how personal information is processed through these providers is available in our Privacy Policy.

We do not guarantee that information provided by third parties will always be accurate, complete, or up to date.

14. Privacy

We process and protect your personal information in accordance with applicable laws and our Privacy Policy.

Some personal information may be processed outside the Republic of Korea by third-party service providers that help us operate the Service.

15. Closing Your Account and Exporting Your Data

You may delete your account at any time through the account deletion feature provided within the Service.

When you delete your account, we will delete your account information and related personal information unless retention is required by law.

Certain User Content may remain in a de-identified form when necessary to maintain the continuity or context of content created by other users. For example, a reply to another user’s comment may remain without identifying you as its author.

You may export a copy of your data through the data export feature provided within the Service.

16. Disclaimers and Limitation of Liability

The Service is provided free of charge on an “as is” and “as available” basis.

To the extent permitted by applicable law, we do not guarantee that the Service will:

  1. meet a particular purpose or expectation;
  2. always be available;
  3. operate without interruption;
  4. be completely secure; or
  5. be free from errors or defects.

We are not required to intervene in disputes between users or between a user and a third party arising from User Content.

To the extent permitted by applicable law, we are not responsible for losses caused by:

  1. your actions or failure to comply with these Terms;
  2. content or conduct of another user;
  3. third-party services, platforms, links, or data; or
  4. circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. Governing Law and Disputes

These Terms are governed by and interpreted in accordance with the laws of the Republic of Korea.

If a dispute arises between you and us in connection with the Service, the court with jurisdiction will be determined in accordance with the Civil Procedure Act of the Republic of Korea.
